Ltd. is a technology consulting and software solutions company providing services including website design and development, Learning Management System (LMS) solutions, WhatsApp Business Automation, AI-powered business solutions, AI content development, business growth consulting, digital marketing, web hosting, cloud-based applications, and custom software development. All services are provided according to mutually agreed proposals, quotations, service agreements, or project specifications.
You agree to use our website and services only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations. You shall not misuse, interfere with, attempt unauthorized access to, reverse engineer, copy, distribute, or exploit any part of our software, applications, websites, or digital services without our prior written permission. Any misuse may result in suspension or termination of services and may lead to legal action where applicable.
Certain services, including Learning Management Systems, WhatsApp Business Automation, hosting services, AI tools, and software subscriptions, may require account registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out under your account. You agree to provide accurate and up-to-date information during registration and to notify us immediately if you suspect unauthorized access to your account.
Where applicable, clients are responsible for obtaining all necessary licenses, approvals, permissions, and consents required for their business operations. Clients using WhatsApp Business Automation acknowledge that the WhatsApp Business Platform is operated by Meta and is subject to Meta’s own policies, including its Business Messaging Policy, Commerce Policy, and Terms of Service. InsightAxis Consulting (OPC) Pvt. Ltd. acts solely as a technology implementation and consulting partner and cannot guarantee approval, uninterrupted service, or policy compliance decisions made by Meta or any third-party platform.
Clients are solely responsible for the content they send through our automation systems, websites, LMS platforms, email systems, or WhatsApp Business integrations. Users must ensure that all communications are lawful, non-spam, non-deceptive, and compliant with applicable data protection and consumer protection laws. We reserve the right to suspend or terminate services if we reasonably believe they are being used for illegal activities, fraudulent purposes, unsolicited bulk messaging, harassment, or violations of third-party platform policies.
Unless otherwise agreed in writing, all project fees, subscription charges, hosting fees, domain registration charges, and recurring service fees must be paid according to the agreed payment schedule. Delayed payments may result in temporary suspension of services until outstanding amounts are cleared. Fees already paid are generally non-refundable except where specifically stated in a written agreement or where required by applicable law.
All intellectual property rights relating to our proprietary software, source code, automation workflows, AI solutions, website templates, graphics, branding, documentation, and business methodologies remain the exclusive property of InsightAxis Consulting (OPC) Pvt. Ltd. Upon full payment, ownership of custom-developed deliverables will be transferred only to the extent specified in the applicable project agreement. We reserve the right to reuse general knowledge, experience, frameworks, and non-confidential components developed during the course of providing services.
We make reasonable efforts to provide secure, reliable, and uninterrupted services. However, we do not guarantee that our website, servers, APIs, hosting infrastructure, AI systems, third-party integrations, or communication platforms will always be error-free, uninterrupted, or available at all times. Temporary interruptions may occur due to scheduled maintenance, software updates, technical failures, cyber incidents, internet outages, or third-party service disruptions beyond our reasonable control.
To the fullest extent permitted by law, InsightAxis Consulting (OPC) Pvt. Ltd., its directors, employees, consultants, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services, including but not limited to business interruption, loss of profits, data loss, goodwill, customer relationships, or revenue, even if we have been advised of the possibility of such damages.
Our website may contain links or integrations with third-party platforms including Meta, WhatsApp, Google, payment gateways, hosting providers, analytics services, and social media platforms. These services operate independently and are governed by their own terms and privacy policies. We are not responsible for the availability, functionality, content, or policies of any third-party platform.
Either party may terminate a service agreement in accordance with the applicable contract or subscription plan. Upon termination, clients remain responsible for any outstanding payments due for services already rendered. We reserve the right to suspend or terminate access to our services if these Terms and Conditions are violated or if continued service would expose us to legal, regulatory, or security risks.
Our Privacy Policy forms an integral part of these Terms and Conditions and explains how we collect, process, store, and protect personal information. By using our website and services, you also agree to the practices described in our Privacy Policy.
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India. Any dispute arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts located in Gujarat, India.
